On the 15th of May 2023, DRC filed a complaint to the CRPD, in a case where a Somali person who had asylum for over 30 years in Denmark, and who was since expelled due to criminal activity, was found to no longer be at risk upon return.

The applicant was homeless, struggling with drug addiction, and was living on a disability pension due to severe PTSD with long list of symptoms including flashbacks, anxiety in interactions with authorities, memory impairment, severe lack of concentration and trouble regulating his temper. He was found to no longer be credible when retelling his original (now 30-year-old) motive for seeking asylum and was denied continued protection. The Danish Authorities further refused to make an individualized risk assessment relating to risks specifically associated with the applicant’s disability.

The complaint argues violation of art. 5, 14 and 15 of the CRPD. On the 17th of May 2023, the Committee granted interim measures.
