Concerning I.M.Y. (represented by counsel, Tage Gøttsche) vs Denmark for violation of articles 7 and 17 of CCPR.
In 1992, the author and his mother came to Denmark from Somalia and were granted resident permits. The author and his mother then decided to move back to Somalia but a few years later the mother came back to Denmark and became a citizen. When she came back, she was carrying the author’s passport which meant that he could not leave Somalia even though he wanted to.
In 2010, Al-Shabaab contacted the author and asked him to join the group. The author did not want to join them and refusing recruitment by Al-Shabaab means risking death. Thus he fled to Denmark and applied for asylum and residence. Both his application for asylum and residence were rejected by the Danish authorities. Thus a complaint was sent to CCPR.
The Committee noted, that the author has failed to provide sufficient information indicating his strong ties with his parents and siblings in Denmark. Thus the committee decided that this communication is inadmissible.
