Concerning Mr. M.A. vs. Denmark violation of CCPR article 6, 7, and 14.

In Afghanistan, the author was attacked by knife by a taxi driver. The author fainted and was hospitalised. The author assumed that the attackers were part of the Taliban. Four months later, armed men came knocking on the author’s door. The author called the police and a shooting erupted between the police and the armed men. The author then fled to Denmark and applied for asylum.

The Danish authorities refused to grant asylum to the author as they found that the author’s statements did not appear credible and that there were inconsistencies as to important facts related to the alleged events. A request to reopen the case was also denied. The author claimed that there was a linguistic misunderstanding that led to differences in his description. However, the Board held that that there was no significant new information in the author’s request. Thus a complaint was sent to CCPR.
Among other observations, the committee noted that the author had the opportunity to review evidence given at each stage of the asylum process and to correct any inconsistencies he found but that he had not done so. Thus the committee decided that the author’s removal to Afghanistan did not violate his rights.
