Political Material Case

Concerning A.P.J vs Denmark for violation of articles 7, 19 and 26 of CCPR.

The author claims that in 2008, he started helping a friend, A.M., who distributed medication smuggled to the Islamic Republic of Iran from Iraq. However, the author found that his friend also transported political material from the Democratic Party of Iranian Kurdistan. One day, Iranian authorities searched the author’s house. In order to avoid being arrested, the author went into hiding during which he got to know that his father had been arrested. The author fled to Turkey and then to Denmark and applied for asylum. While in Denmark, he participated in several demonstrations against the Iranian authorities, held in front of the Iranian embassy.
The Danish authorities denied asylum to the author as they found his claim to be unreliable.Thus a complaint was sent to CCPR. The Committee found that while the author disagrees with the factual conclusions of the Board, he has failed to show that they were arbitrary or manifestly erroneous or amounted to a denial of justice. The Committee was of the view that the author’s removal to the Islamic Republic of Iran did not violate his rights under article 7 of the Covenant.
