Promised to a powerful man

Concerning M.J.K vs Denmark for violation of articles 6, 7, 14, 18 and 26 of CCPR.

The author and his spouse P, started a relationship in Afghanistan in 2007. At that time, P was promised to a powerful man, Mr. A.K. When A.K found out about the author’s relationship with P, he attacked the author and threatened to kill him. Thus the author and P fled from Afghanistan to Iran and then to Greece where they got married. Due to the poor living conditions in Greece, P fled to Italy. Because the author did not hear back from her, he came to Denmark and applied for asylum.  

The Danish authorities rejected the author’s application for asylum as they considered that the author had been incoherent and inconsistent during the asylum proceedings. In the meantime, the author had converted to Christianity and requested a reopening of the case. This request was rejected too. However the author’s new council succeeded in reopening the case. Nevertheless, the Danish authorities did not consider the author’s conversion to be genuine. Thus a complaint was sent to CCPR.

The Committee observed that the author has not identified any irregularities in the decision-making process, or any risk factor that the State party’s authorities failed to take properly into account. Thus the committee declared the communication to be inadmissible.
